What is a Clausula Suelo or Floor Clause?

It is a clause in a Spanish tracker mortgage agreement that requires you to pay a minimum interest rate, even when the interest rate that the mortgage is tracking – such as the Euribor – is lower.

This means that you could be paying thousands of Euros more than you should be, and the European Court of Justice and the Spanish Supreme Court has agreed that these clauses are abusive and you are entitled to make a claim.

Who can make a claim?

Anybody who at some stage has had a Spanish mortgage. It does not matter if you still pay the mortgage, have paid it off or even have sold the property, you can still claim back the money you overpaid!

What paperwork is needed to check if I have a claim?

Just a mortgage statement. If you have the mortgage deed then great, but if you have a mortgage statement showing the breakdown of capital and interest then we can normally see if you were overcharged.

Since the Royal Decree which came into effect in January 2017. The bank must respond to a claim within 12 weeks of submission. If they do not, then we will submit a case file to the court. In most cases this is when the bank will pay, if not then they are due all court costs which will mean an extra 30-40% for them to pay. In reality most cases will be completed in 4 months.
